Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", or "user") and Bonaire Brokers b.v. ("Bonaire Brokers", "we", "us", or "our"), a company registered in Bonaire, Caribbean Netherlands, with its registered office at Kaya Ir Statius van Eps 17, Belnem, Bonaire, Caribbean Netherlands (Chamber of Commerce / KvK no. 13489, CRIB no. 310028814). They govern your access to and use of the website at bonaire-brokers.com and all related pages, content, tools, and services (together, the "Platform"). Please read them carefully.
By accessing or using the Platform — including by browsing listings, creating an account, requesting a valuation estimate, or submitting a listing — you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Notice and Cookie Notice, which are incorporated by reference. If you do not agree, you must not use the Platform.
Our mission & commitment to impartiality
Bonaire Brokers exists to make the island's property market open and transparent: we bring the
listings of every broker together in one place, so buyers can discover any property on Bonaire
and owners can reach the whole market. We are an independent and impartial
platform. We do not act for any single broker, agent, seller, or buyer, and we do not
favour one over another. Placement and search results are not for sale;
participating brokers are presented on equal terms; and because we earn nothing from displaying
brokers' listings, we have no incentive to promote one listing above another. Our aim is simply
to show the market as it is — accurately, fairly, and in everyone's interest.
All Participating Brokers are represented equally: they carry the same weight when
voting on our roadmap, and all Participating Brokers are equally eligible to be
proposed when a user is prompted to 'select representation'.
1. Who we are & what the Platform is
Bonaire Brokers is an online information platform and marketplace for real estate on Bonaire. We aggregate and display property listings from third-party brokers and agents, provide tools for owners to list property themselves ("For Sale By Owner" or "FSBO"), offer an automated property-valuation estimate, and help connect interested parties with brokers and sellers. We are not a licensed real estate broker, agent, makelaar, appraiser, mortgage broker, or legal or tax adviser, and we do not act as one.
2. No agency or broker relationship
We are not a licensed real estate broker, agent, or makelaar, and we do not represent buyers, sellers, landlords, or tenants, or negotiate on anyone's behalf. No agency, partnership, joint venture, employment, or fiduciary relationship is created between you and Bonaire Brokers by these Terms or by your use of the Platform.
For For Sale By Owner (FSBO) sales we act as a neutral intermediary: we provide the platform, listing tools, and (where used) a contract generator, and we earn a success fee on a completed sale (see the User Agreement). Even then, we do not represent either the seller or the buyer, do not advise on or negotiate the price or terms, and are not responsible for the sale itself — its terms and outcome are agreed between, and are the responsibility of, the buyer and the seller. For listings provided by brokers and agents we display the listing and may forward inquiries; any resulting communication, agreement, or transaction is between those parties, and forwarding an inquiry does not make us a party to it or create an agency relationship of any kind.
3. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Platform. Some features require an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account, and you must notify us promptly of any unauthorised use. You may close your account at any time by contacting us; closing it does not affect content or records we are required, or reasonably need, to retain.
4. Listing information & third-party data
Listings and property information on the Platform are supplied by third-party brokers, agents, data partners, and individual users, or are aggregated from publicly available broker sources. We do not verify, and we make no representation or warranty about, the accuracy, completeness, currency, reliability, or suitability of any listing information — including property descriptions, photographs, measurements, lot or living areas, prices, availability, legal or ownership status, zoning, or permits.
Listing information is provided for general informational purposes only and is supplied "as is". It must not be relied upon as the sole basis for any decision. Aggregated data may not reflect a broker's current, authoritative listing, and errors may be introduced during aggregation. Bonaire Brokers is not the listing agent for any property. You should independently verify all material facts with the listing broker, the seller, and a qualified professional before acting.
Our listings vs third-party listings. A "Platform Listing" (our listing) is a listing created in the Bonaire Brokers database through our tools — for example a For Sale By Owner listing — whether or not it has been approved or published for public display. We record the date each Platform Listing is created and the date it is published. A Platform Listing is distinct from a third-party listing that originates with a broker and is only aggregated or displayed by us. Once a property has a Platform Listing, selling it through a broker afterwards is subject to our FSBO-origin fee — and the listing's creation and publication dates determine this — as set out in the User Agreement and Broker User Agreement.
5. Participating & non-participating brokers
A "Participating Broker" label means a broker cooperates with Bonaire Brokers through our platform tools, listing-management features, or inquiry workflows. It does not mean we certify, verify, endorse, license, supervise, or guarantee that broker, their listings, or their conduct. All participating brokers are presented on equal terms (see our mission, above).
Listings and broker profiles may include content from participating brokers, pending brokers, non-participating brokers, or other public sources. Where a broker does not participate, we may display platform-generated descriptions, summaries, labels, or artist impressions in place of the broker's own material, while keeping the original source on record internally. We never represent a listing as verified, exclusive, certified, or guaranteed by Bonaire Brokers. If you are a broker or rights-holder and believe content is inaccurate, unauthorised, outdated, or should be removed, contact us using the process in section 13.
6. Property valuation estimates
Where the Platform provides an estimated property value (an "Estimated Value"), that figure is generated by an automated valuation model that applies statistical analysis to available market data, comparable sales, and property characteristics. An Estimated Value is not an appraisal and is not a formal or professional valuation carried out by a licensed or certified appraiser or makelaar. It is not financial, mortgage, investment, tax, or legal advice, and it is not a broker price opinion.
An Estimated Value may differ significantly from a property's actual market value. It cannot account for condition, recent improvements or damage, legal encumbrances, or local market nuances that a professional would consider. You must not use an Estimated Value as the sole or primary basis for any purchase, sale, mortgage, financing, or investment decision. We strongly recommend obtaining a professional appraisal and advice before you act. Use of any Estimated Value is entirely at your own risk, and we make no warranty as to its accuracy or reliability.
Permitted use. The valuation tool is provided for personal, non-commercial use only and is not intended for brokers or other commercial use. For a professional valuation, please use a qualified appraiser (taxateur). If you would like to use the tool commercially, please contact us to arrange it.
7. Mortgage & financial calculators
Any mortgage calculator, monthly-payment estimate, affordability indication, interest-rate assumption, or other financing figure on the Platform is for general information only. Bonaire Brokers is not a lender, mortgage broker, or financial, tax, or legal adviser. Actual loan terms, eligibility, payments, taxes, insurance, transfer costs, and closing costs depend on your circumstances and on third-party decisions, and may differ materially from any estimate shown. Consult a qualified lender, mortgage adviser, notaris, or tax adviser before making any financial decision.
8. BoB & AI-assisted features
"BoB" and other AI-assisted features are automated tools — not a human, and not a broker or professional adviser. They use artificial intelligence to generate responses and will identify themselves as automated.
By using BoB or other AI features, you understand that:
- responses are AI-generated and may be inaccurate, incomplete, outdated, or inappropriate for your situation — even when they appear confident;
- BoB does not provide legal, tax, mortgage, investment, appraisal, or professional real-estate advice, and cannot guarantee any listing's price, availability, size, status, fees, or taxes;
- BoB cannot make offers, promises, or commitments on behalf of any broker, seller, buyer, or Bonaire Brokers, and nothing it says is a binding quote or offer;
- you must independently verify anything important before relying on it, and contact the relevant broker or a qualified professional for authoritative information.
Do not share sensitive information — such as passwords, bank or payment details, your tax number (CRIB), or confidential legal matters — with BoB; it is not a secure channel for confidential data. Conversations may be logged, reviewed, routed, or escalated, and are handled as described in our Privacy Notice. The AI assistant is provided "as is", without warranty of accuracy or availability.
9. For Sale By Owner (FSBO) & user content
If you submit, upload, or publish any content to the Platform — including FSBO listings, photographs, descriptions, videos, messages, or other materials ("User Content") — you grant Bonaire Brokers a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, use, reproduce, adapt (for formatting and display), publish, and distribute that User Content for the purpose of operating, promoting, and providing the Platform and its services.
You represent and warrant that: (a) you own your User Content or have all rights, licences, and permissions necessary to grant the licence above; (b) your User Content does not infringe or violate the intellectual-property, privacy, publicity, or other rights of any third party; (c) every photograph you submit is owned by you or used with the explicit permission of the copyright holder (which may be a professional photographer); (d) your listing is truthful and accurately describes the property; and (e) your User Content complies with all applicable laws, including non-discrimination and fair-advertising rules.
User Content must not be false, misleading, fraudulent, defamatory, discriminatory, harassing, obscene, or otherwise unlawful. We may review, edit, refuse to publish, or remove any User Content at any time, with or without notice, at our discretion — including content we believe breaches these Terms. Removal does not relieve you of responsibility for prior violations. You remain solely responsible for your User Content and for your dealings with any party who contacts you through it.
10. Messaging & lead routing
The Platform may let you send inquiries to brokers or sellers and may forward your message and contact details to the relevant party. You are responsible for the content of your messages. You must not use the messaging features to send spam, unsolicited commercial communications, or unlawful, abusive, or deceptive content. We do not guarantee that any recipient will read or respond to a message, and we are not responsible for the conduct of, or any agreement reached with, any party you contact through the Platform.
11. Acceptable use
You agree not to:
- use the Platform for any unlawful purpose or in breach of these Terms;
- scrape, crawl, spider, harvest, or otherwise systematically extract data or content from the Platform without our prior written consent;
- use any robot, bot, script, or automated means to access, query, or monitor the Platform;
- use Platform data or content to train, develop, or ground any machine-learning model, artificial-intelligence system, or generative-AI tool;
- reproduce, distribute, modify, create derivative works of, frame, mirror, or commercially exploit any part of the Platform without our express written consent;
- reverse engineer, decompile, or attempt to derive the source code of the Platform;
- post false, misleading, or fraudulent listings or information, or impersonate any person or entity;
- invent, falsify, or misrepresent a property's address or neighbourhood in any listing;
- include hyperlinks, URLs, or other external links in a listing description;
- harass, abuse, or harm any user, broker, or third party;
- introduce viruses or malicious code, or interfere with or disrupt the integrity or performance of the Platform;
- solicit users away from the Platform for a competing service.
12. Intellectual property
The Platform and its contents — including its software, design, layout, text, graphics, and the materials we have independently compiled, selected, arranged, or created ("Platform Content") — are owned by Bonaire Brokers and its licensors and are protected by copyright, database rights, trademark, and other laws. The selection, arrangement, and compilation of listing data on the Platform is itself a protected work and database; you may not extract or re-use substantial parts of it for any commercial purpose without our prior written consent.
Listing content provided by brokers, agents, or other third parties (including descriptions and photographs) remains the property of the respective rights holders, and we publish it in reliance on the authorisation of the party that supplied it. If you believe content has been published without authorisation, see section 13.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended, non-commercial purpose. All rights not expressly granted are reserved.
13. Copyright & takedown notices
We respect the intellectual-property rights of others. If you believe content on the Platform infringes your copyright or other rights, please email info@bonaire-brokers.com with: (a) your signature (physical or electronic), or that of a person authorised to act for the rights holder; (b) identification of the work claimed to be infringed; (c) the specific URL or location of the material on the Platform; (d) your name, address, telephone number, and email; (e) a statement that you believe in good faith the use is not authorised; (f) a statement that the information in your notice is accurate and that you are the rights holder or authorised to act on their behalf; and (g) reasonable proof of ownership of the work or of your authority to act for the rights holder — for example registration or deposit records, the original or higher-resolution source file, dated creation files or metadata, an earlier-dated publication, a licence or commission agreement, or, for an authorised agent, written authority from the rights holder.
On receiving a notice we will review it and take appropriate action, which may include removing or disabling access to the disputed content. We may request reasonable proof of ownership or authority before acting where ownership is unclear or disputed, and may decline to act on a notice that lacks it. Submitting a notice that materially misrepresents that material is infringing may expose you to liability. We may terminate the accounts of repeat infringers. If you believe content of yours was removed in error, you may send a counter-notice to the same address.
14. Third-party websites & content
The Platform may link to, or display content from, third-party websites, brokers, agents, and data partners. We do not control, endorse, or assume responsibility for the content, products, services, or practices of any third party, even where reached through a link on the Platform. Your use of any third-party site or resource is at your own risk and subject to that party's own terms and privacy policies.
15. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Platform and all content, information, tools, and services on it are provided "as is" and "as available", without warranty of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free, that defects will be corrected, that it is free of viruses or harmful components, or that any information or Estimated Value on it is accurate, complete, reliable, current, or fit for any purpose. Any reliance you place on the Platform is at your own risk. Nothing in these Terms excludes or limits any right or guarantee you have under mandatory consumer-protection law that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by applicable law, Bonaire Brokers and its directors, employees, affiliates, agents, licensors, and service providers will not be liable for any indirect, incidental, special, or consequential loss, or for loss of profit, revenue, data, goodwill, or anticipated savings, arising out of or in connection with these Terms or your use of, or inability to use, the Platform — even if we have been advised of the possibility of such loss.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to these Terms or the Platform is limited to the greater of (a) the total amount you paid us, if any, in the twelve months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms limits liability for fraud, for death or personal injury caused by our negligence, for intent or gross negligence, or for any other liability that cannot lawfully be limited. Where mandatory law gives you rights that these limitations may not restrict, those rights are unaffected.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Bonaire Brokers and its directors, employees, affiliates, agents, and licensors from and against any claims, liabilities, damages, losses, and reasonable costs (including legal fees) arising out of or connected with: (a) your use of the Platform; (b) your User Content, including any claim that it infringes a third party's rights; (c) your interaction with any user, broker, or other party through the Platform; (d) any property damage or personal injury arising from a listing you post or a viewing arranged through the Platform; or (e) your breach of these Terms or of any applicable law.
18. Suspension & termination
We may suspend or terminate your access to the Platform, in whole or in part, at any time and without notice, if we believe you have breached these Terms, engaged in fraudulent or abusive conduct, or where required by law, or for any other legitimate reason. Termination does not affect rights or obligations that arose beforehand. The provisions that by their nature should survive — including sections 4–6 and 9–18 — survive termination.
19. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will update the effective date above and, where appropriate, give notice on the Platform or by email. Changes take effect when posted. Your continued use of the Platform after a change takes effect means you accept the revised Terms.
20. Governing law & jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Platform, are governed by the law applicable in Bonaire as a public body of the Kingdom of the Netherlands (the Caribbean Netherlands), including the Burgerlijk Wetboek BES and the Consumentenbeschermingsverordening BES, without regard to conflict-of-law rules. The competent court for Bonaire — the Gerecht in eerste aanleg van Bonaire, Sint Eustatius en Saba — has jurisdiction over any dispute, save that we may seek injunctive relief in any court of competent jurisdiction. If you are a consumer, this does not deprive you of the protection of any mandatory law that applies to you.
21. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full force, and the invalid provision will be replaced by a valid one that comes closest to its intended effect. Our failure to enforce a provision is not a waiver of it. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Cookie & Privacy Notice and any policies referenced in them, are the entire agreement between you and Bonaire Brokers regarding the Platform and supersede any prior agreement on the subject. These Terms may be made available in English and Dutch; if there is a conflict, the version required by mandatory local law prevails for consumers.
